Terms of service: Kayabyte apps for HubSpot

These terms apply to the HubSpot apps provided by Kayabyte, the trading name of Caner Kaya, Stasjonsveien 64, 0771 Oslo, Norway (we, us).

Use of the apps

By installing an app you agree to these terms. You may use the apps on HubSpot accounts you own or are authorized to manage.

Plans and payment

Plans and prices are shown on each app’s listing and pricing page. Paid plans are billed by Kayabyte through Stripe, monthly or yearly, and renew until cancelled. You can cancel at any time; the plan stays active until the end of the paid period. Refunds follow the policy on the app’s pricing page.

Your data

You keep all rights to your data. We process it only to provide the apps, as described in the privacy policy.

Contacting you

We contact you only to answer your support requests and to inform you about important changes to an app, such as changes to these terms. We do not send marketing messages.

Availability and support

We aim to keep the apps available and to answer support requests within one business day, Monday to Friday, 09:00 to 17:00 Central European Time. The apps depend on the HubSpot platform; HubSpot outages or platform changes can affect them.

Service level

• Availability target: 99.5% per calendar month for each app’s backend, excluding scheduled maintenance (announced on the support page at least 48 hours ahead) and outages of HubSpot or our hosting provider.
• Support response: first reply within one business day; for incidents that stop an app working for all users, within 4 business hours.
• If we miss the availability target in a month, customers on a paid plan can ask for a credit of 10% of that month’s fee for each full percentage point below the target, up to 50%.

Warranty and liability

The apps are provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid for the app in the twelve months before the claim.

Termination

You can stop using an app at any time by uninstalling it. We may suspend an app for accounts that misuse it.

Governing law

These terms are governed by Norwegian law.
